These Terms of Use ("Terms") govern your access to and use of the website cupidon.top and all related services, features and applications (together, the "Service"), operated by Cupidon.Top Media ("we", "us", "our").
By creating an account or using the Service, you confirm that you have read, understood and accepted these Terms, our Privacy Policy and our community standards. If you do not agree, please do not use the Service.
Eligibility
1.1. You must be at least 18 years old to use the Service. By registering, you confirm that you are 18 or older.
1.2. You must be legally competent to enter into this agreement and must not be barred from using the Service under the laws of your country of residence.
1.3. One person, one account. Creating accounts on behalf of another person, or using automated means to create accounts, is not allowed.
1.4. We may ask you to verify your age or identity at any time. Accounts that fail verification, or that we reasonably believe belong to a minor, are closed immediately.
Your account
2.1. You must describe yourself truthfully: your age, photos, location, interests and intentions must be accurate and up to date.
2.2. You are responsible for the accuracy of the information in your profile and in your compatibility questionnaire answers, and for keeping your login credentials confidential.
2.3. You are responsible for all activity that takes place through your account.
2.4. Notify us immediately at [email protected] if you suspect unauthorised access to your account.
Compatibility, matching and contact
3.1. Compatibility suggestions are generated automatically from the answers you provide. They are recommendations only, do not guarantee any outcome, and are not a statement about any person's character.
3.2. Private messaging opens only when both members have shown interest in each other. Sending messages to a member who has not shown interest is not possible and is not permitted by other means.
3.3. Interest is personal and revocable. Showing interest is not consent to sexual content, to a meeting, to sharing personal data or to any other act.
3.4. If a member stops the conversation or blocks you, you must stop contacting that member immediately, on the Service and elsewhere. Repeated contact attempts, or contact through other accounts, is a serious breach of these Terms.
3.5. You must respect the controls other members set on their profiles, including hidden or paused profiles, and you must never publish, forward or republish private messages, photos or personal data of another member without their explicit permission.
3.6. Members are free to stop any conversation at any time and are not obliged to give a reason.
Acceptable use and prohibited content
4.1. The Service is intended for lawful dating and social discovery between adults.
4.2. The following content and conduct are strictly prohibited, and this list is not exhaustive:
(a) pornographic or sexually explicit material of any kind, including images, video, audio, text, links or illustrations;
(b) nudity, sexually suggestive or fetish content, and content intended to produce sexual arousal;
(c) offers, requests or advertising of escort services, prostitution, sexual services, "sugar dating" arrangements, erotic massage, webcam sex or any other paid sexual service;
(d) any sexual content involving minors, any attempt to contact a minor, and any form of child sexual abuse material - such content is reported to the relevant authorities;
(e) human trafficking, exploitation, coercion, pimping or the promotion of any of these;
(f) harassment, stalking, threats, hate speech, defamation, blackmail, sextortion or non-consensual sharing of intimate images;
(g) fraud, romance scams, phishing, money laundering, or any request for money, gift cards, crypto or financial data;
(h) spam, bulk messaging, advertising, referral links, multi-level marketing or commercial solicitation;
(i) impersonation, fake profiles, bots, stolen photos, catfishing, or misrepresentation of your identity, age, gender, relationship status or intentions;
(j) content that infringes intellectual property, privacy or other rights of third parties;
(k) malware, scraping, automated access, or attempts to break the security or the integrity of the Service, including manipulation of the matching system;
(l) any activity that is illegal under the laws applicable to you or to us.
Moderation and enforcement
5.1. We use automated tools and human review to detect prohibited content and behaviour, including fake profiles, bots and manipulation of the matching system.
5.2. We may remove content, issue a warning, restrict features, suspend or permanently terminate an account, with or without notice, if we believe these Terms have been breached.
5.3. We cooperate with law enforcement where required by law or where there is a risk of harm.
5.4. You can report content or users through the report function or by writing to [email protected].
Your content and licence
6.1. You keep ownership of the photos, text and other material you upload ("Your Content").
6.2. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for technical purposes such as resizing) and display Your Content solely to operate, provide and promote the Service.
6.3. You confirm that you own Your Content or have all necessary rights, that everyone shown in it has agreed to its publication on the Service, and that it does not break any law or third-party right.
6.4. We may remove Your Content at any time if it breaches these Terms.
Our intellectual property
The Service, its design, software, text, logos and trademarks are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell or reverse-engineer any part of the Service, including the compatibility questionnaire and matching logic, without our prior written consent.
Privacy
Our Privacy Policy explains what personal data we collect, why we collect it and what rights you have, including how we use your questionnaire answers. It forms part of these Terms.
Availability, changes and paid features
9.1. The Service is provided on an "as available" basis. We may modify, suspend or discontinue any part of it, and we do not guarantee uninterrupted or error-free operation.
9.2. If we offer paid features, the price, billing period and cancellation rules are shown before you buy. Statutory consumer rights remain unaffected.
9.3. We may update these Terms. Material changes are announced on the website or by email. Continued use after the effective date means you accept the updated Terms.
Disclaimers and limitation of liability
10.1. We do not conduct criminal background checks on members and we do not guarantee the identity, intentions, behaviour or truthfulness of any user.
10.2. We do not guarantee that you will find a partner, a date or any particular number of matches, and compatibility suggestions are provided without any warranty of success.
10.3. You are solely responsible for your interactions with other users, both online and offline, and for the personal information you choose to share.
10.4. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
Indemnity
You agree to indemnify and hold harmless Cupidon.Top Media and its officers, employees and partners from claims, damages and reasonable legal costs arising from your breach of these Terms or your unlawful use of the Service.
Termination
You may delete your account at any time in your account settings. We may terminate or suspend your access if you breach these Terms. Sections on intellectual property, liability, indemnity and governing law survive termination.
Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York, unless mandatory consumer protection law in your country of residence provides otherwise.
